For an appeal to be successful with the AAT's decision, the applicant must convince the appellate judge that the AAT has made an error of law and that this error contributed to the decision being appealed.

Mistakes in the law may include:

• Denial of procedural impartiality to any party;
• Misinterpretation of procedural law.

However, when an error of law is shown, the judge may dismiss the appeal if he or she deems that the AAT has reached a decision that was clearly correct on the previous material.
